General Terms

1. General

‍These General Terms and Conditions apply to all offers, agreements, and transactions between Berend Strik (hereinafter "the Artist" or "Studio") and the buyer (hereinafter "the Client") via the website [berendstrik.nl] (the "Website"). By placing an order or commissioning an artwork, the Client agrees to these terms.

2. Artworks & Authenticity

• Unique Nature: Unless explicitly stated as an edition, every artwork sold is a one-of-one original. Due to the handmade nature of 'stitched photography,' slight variations in texture, thread tension, and color are inherent to the work and do not constitute defects.
• Certificate of Authenticity: Every original artwork is accompanied by a signed Certificate of Authenticity.

3. Pricing and Payments

• Pricing: All prices are stated in Euros (€) and include VAT (Value Added Tax) where applicable, unless explicitly stated otherwise. Customs duties and import taxes for international shipments are the sole responsibility of the Client.
• Payment Gateway: Payments are securely processed through our third-party payment provider, Mollie. We accept major credit cards, iDEAL, and other payment methods supported by Mollie.
• Commissions (Bespoke Works): For commissioned artworks, a non-refundable deposit of [e.g., 50%] is required before work commences. The remaining balance must be paid prior to delivery.

4. Shipping and Delivery

• White-Glove Delivery: Due to the monumental and delicate nature of the artworks, shipping is handled via specialized art logistics partners.
• Risk and Transfer: The risk of loss or damage transfers to the Client at the moment of delivery. The Client must inspect the artwork immediately upon arrival and report any transit damage within 24 hours.

5. Returns and Right of Withdrawal

• Standard Artworks: Under EU consumer law, EU-based Clients have the right to return a standard artwork within 14 days of receipt without providing a reason. The artwork must be returned in its original, undamaged "gallery condition" and in its original packaging. Return shipping costs and insurance are the responsibility of the Client.
• Exceptions (Commissions): The right of withdrawal does not apply to commissioned, bespoke, or highly personalized artworks created specifically for the Client.

6. Intellectual Property & Copyright

• Purchasing an artwork grants the Client physical ownership of the piece. However, Berend Strik retains all copyrights and reproduction rights to the image and the artwork.
• The Client may not reproduce, distribute, or use the artwork for commercial purposes without prior written consent from the Artist.

7. Governing Law
‍These terms are governed by the laws of the Netherlands. Any disputes arising from these terms or related transactions will be submitted to the competent court in Amsterdam, the Netherlands.
